Ex on Probation for Criminal Non Support

My question involves child support in the State of: Missouri

My ex is on his 2nd charge of criminal non support and is on probation a 2nd time. He was ordered to pay 225/month till arrears are meet then 150 a month. He paid 80 bucks this month. Does that mean his probation is revoked and he will go to jail? I really hope so because he was also ordered to pay for medical insurance starting in 2008 and hasnt since 2009. Does he just get to pay whatever he wants when he wants or will the state put him in jail?

How do you think jailing him is going to get you your child support?

Well, I think he should do some shock time because it would be the only punishment that will wake his butt up. I have tried all recourse for punishment and I want him punished by the full extent of the law not some sissy punishment lol. It’s not my fault he sucks as a human being, but he will pay his child support especially since I dropped it from 400 a month to 150 b/c I knew he wouldn’t ever pay the 400 at least he has no excuse for not paying the 150. And the medical was a stipulation b/c I have a heart condition and couldn’t get either my son or self insured. He provided the insurance for 3 months till he got fired for assault on the job. My husband provides our insurance now but it is draining. My ex doesnt even pay enough a month for my gas to meet him so he can see his kid. And god forbid he have clothes or a bed for my son when he does get to see him.

That's not going to wake his butt up, I'm afraid.

If he's not working, he can bring up his unemployed status and might actually (even with an assault, believe it or not) get away with this for a little longer if he can convince the powers that be that he's diligently searching for work.

So who is the order with? CSE or the courts?

No he is working he owns his own company and was found in contempt for hiding the money.

the order is with CSE. and has been since 2008 when my son was 5 and we had been on MC+ for 5 yrs

Oh good lord. Okay, then if I were you I would be a gentle little bee in the ear of CSE. Don't call every day, but keep in contact and keep them informed. That's really all you can do at this point.

Thanks for being positive lol. I know my case worker pretty well she has been there the whole time for me and she will call me after i leave work to update me on the case. I dont ever call them cuz she told me all she can do is pass the info to the PA of Missouri. Im just at the end of my rope especially when he gets all demanding about me meeting him halfway so he can see his son for 48 hrs then meeting him again. thats more in gas then child support. He actually complains that my son cant miss school to hangout and gets mad because my son wants to play baseball cuz that takes his time away and he said he aint coming up here to watch some little kids baseball game. Sorry for the venting lol but Jeez he needs a wake up call. Maybe spend his cs on a santa to go kick his butt lol Whats he gonna do tell the cops santa beat him up.

Oh his defence for not paying this time was the fact that i got married and my dad gave me a house??? really that doesnt mean you dont pay your child support. I just want him to pay so i can use the money for like dentist visits and er stuff Im not getting rich off your 30 bucks u paid in July dude lol. Oh and i got his tax refund last yr due to all the arrears and he told the judge he was not guilty till i gave reciepts for what i used the child support for really lol He is wrong and he knows it he filled guilty after he got laughed out of court.

Oh right now he owes 685 just in arrears. He paid 25 in June and 30 in July and after he went on probation he paid 80 but probation said he was to pay 225 for Sept

Do you think he will get a probation violation? Maybe him spending money on not paying his support would make him pay lol

I think given what you've posted here today, there's a decent chance he'll spend at least a little time enjoying three hots and a cot.

I'm all for giving someone a break, truly. If he'd been laid off from work and genuinely couldn't find another job in the same industry for example; I'd likely be more than willing to give the guy a chance to get back on his feet. But some parents are just deadbeats and don't deserve sympathy for getting their behinds tossed in jail for criminal non-support.

Jail is generally the LAST resort. He's obviously got a long history of willful non-payment. So now he faces the consequences of his (in)actions!
