An Adult May be Having Sex with my 13-Year-Old niece.
edit : Some weird typo in the title.. no idea how it got their.
The girl is "13", not "3".

My question involves criminal law for the state of:
    California

I'm talking about a 18yo boy, he and his father live in the same house as my brother, my brother's wife and my brother's kids. His father is a childhood friend of my brother and his wife. They all 3(6 including kids) live together... for whatever reason.

I do know that their kids are friends..
One is 18(the one i'm talking about).
The other 2, my nephew and niece, are 18 and 13.(the girl is 13).

My niece and that 18yo have always seemed a bit to close.. She always sit in his lap if they are watching TV or playing video games. She hugs him.. Not in the "just friends" way.. I might add.

I once caught her masturbating to a picture of him, while moaning his name.. Something I found highly disturbing..

I tried following him around, to see what he was doing to her..
I've seen them holding hands.. Them kissing. I'm pretty sure I saw him with his hands in her pants..

Obviously, I told her direct family about this. They where surprised.. But they didn't seem to mind.
Her mother even thought it was cute! and my brother? he didn't even mind it..
So they won't help me on this.

But sadly, I have a problem..
I won't be-able to report this and get this pedo convicted..

I have no proof. Plenty of people know I hate his dad..
    Which is not that surprising..

That sick **** used to date/have sex with my little sister. When he was 19 and she was 13..
Its all repeating itself again... The worst part is that he is the last one to have ever spoken to her before she died.. To this day, I still don't know why she picked him..

You know that if you get a operation, 1 person is allowed to be in the operating room until that gas/medicine/whatever it is starts working? Well.. you know who she picked when she had to get a operation for her brain tumor? that's right.. her "boyfriend"..

She did not survive it.. Which was a horrible thing on its own.. But that sick **** even dared to come to her funeral, at which point I got so pissed I just told my parents everything I knew about him and my sister..

They of-course kicked him out(of the place where they held the funeral), after that my brother never spoke to me parents.. for whatever reason. I still talk to him from time.

My point is, they know I hate his father.. so they assume I also hate/dislike his son(which is true).
So.. I doubt anybody would believe on this.. My word is not enough proof. They would just assume I want ruin his life.

So.. any tips on how to get more proof? Or how to stop them from dating?

    Extra info :
I don't think recording it will work.. They noticed me when he had his hand in her pants.
I doubt he will do something illegal in a public place again.(holding hands is not not illegal here..)
I checked her chat logs(went to her room when she went showering). I found enough proof of them "being in love" on it, it was about them loving eachother or whatever.. But nothing about them kissing or having sex..

Another problem is that I tried reporting it, but they just denied they did anything sexual.
I really need to find a way to get more proof, anything else will just not work.

I'm sorry if this is to long, or if my grammar is horrible.
I just really want to get him behind bars, I don't want him to ruin my niece's life.

Exactly WHO did you report it to? And it sounds like whomever you reported to DID talk to BOTH of them, is that correct?
