Access to Grandchildren

I was wondering what rights do Gradparents have to there Grandchild?? I have one Grandchild that I love so dearly.. My daughter and the father of my grand baby do not get along. Dose he have the right to not allow us to see the baby. There is no custody between them. They just pass him back and forth. But can he get mad and say he dosent want us to see him just for meanest????

You have no inherent rights. If you want to petition for grandparent visitation, you will need an attorney and you will need to show that you have an existing bond with the baby. You would also have to file against your daughter.

But I have a quick question - why can't you see the baby during your daughter's parenting time?

I can see the baby just about any time I choose. But the father of my grandson thinks he is God almighty and threatens all the time that we cant see him. It was just a question incase somthing like that goes wrong...

If Mom & Dad break up, you would still be able to see your grandson during your daughter's parenting time. Therefore the court would not order grandparent visitation.

If both of them decide they don't want you around, you'll have to file a lawsuit against both of them. You will absolutely need an attorney. And you should think very, very carefully about this course of action. Suing your own child is generally seen as a hostile act and if you lose, there's a strong chance you'll never see either of them until your grandson is well beyond 18 years old.

The bottom line is, you currently have no "rights" to see your grandson.

You need to take a step back.

As far as the child goes, the father of the grandson IS God Almighty... with absolute right to decide who does and does not associate with his child... well, on his time, anyway.

If he can prove you are interfering with custody or, say, trying to bad mouth him about his parenting because he isn't jumping to the hoops YOU think he should, he can and SHOULD get a restraining order to keep you away from his child.

In a nutshell... if you want to keep a relationship with the grandchild, I would start worshiping at the altar of father of the grandson. If he can convince a court that your involvement is toxic to HIS relationship with HIS child, you will lose.

nobody is saying or asking anything from him. The father is an abuser to my daughter not to the child. and she is affraid of him. he just dose things for pure meanest. cause he CAN!!!! We do anything and everything for the baby. we are not on speaking terms.(the father and I) he has a criminal back ground. and he has even shoot at my son because he has hit my daughter. Theres alot more to this I AM NOT THE BAD PERSON HERE>>>>> I can"t do nothng about this because they are grown adults. She has to press charges against him for the abuse to her... And if he dose get a wild hair up his butt. He always finds away for us not to see him. He just scares me cause he dose have the control.... Myself I was only asking if I had any rights to see him.. That is just so sad.. But I guess thats the law.. And whats so bad about that a grandchild brings so much joy to your life.. There is no other feeling like that.. But thank you for your feedback...

The law is that way because parents have the constitutional right to decide who may or may not be around their children.

Some States don't even allow for grandparents to sue for visitation. Kentucky is one state which does allow them to sue.

I suppose I'm not understanding why your daughter can't bring the child to see you. Is Mom agreeing with Dad's opinion on the matter? If that's the case, you really don't have much option except to be extremely nice to your daughter and hope she comes around.

GPV suits are costly and can be emotionally devastating. And if the child is an infant, unless you actually raised the child yourself it would be extremely difficult to prove that by not having court ordered visitation the child will be damaged (and that is basically the burden).
