    How Can I Protect My Mother's Rights
    My question involves paternity law for the State of: Tennessee

    I have a five month old baby. His biological father is married to another woman. We have never been married and haven't been in a relationship with him my whole pregnancy. He didn't help me to pay any medical bills while I was pregnant, and never gave me any money for a child. He simply doesn't have any money because he never works.

    I did not let him come to hospital and his name is not on a birth certificate. But I let him and his parents to see baby since he was born.

    I'm a foreigner and I don't want him to have right forbid me to take my baby back to my country if I decide to leave US.

    I want to understand my situation better. What if he decides to put his name on a birth certificate... will it cost him a lot of money to do it through the court? If I get married and my husband would adopt the baby does he still have a right to establish paternity? If he goes to the court and I leave the US before the decision is made will I have any problems later? Can he still do anything if I move to the different state?

    Your child only has one legal parent at the moment - that's you.

    However he can file to establish paternity at ANY time. It could cost him nothing at all. You cannot have anyone adopt the child without at least notifying your ex.

    And yes, he can cause an awful lot of trouble for you if you move out of State and the country.

    But perhaps the important question is, what does HE want to do?

    How can it cause me a trouble if I'm the only legal parent of a child before the decision is made?

    And does he have to pay child support if he is unemployed?

    Please read what I said.

    It can cause you a lot of trouble IF you move. I did not say anything about you moving BEFORE anything was decided.

    Yes, he will be liable for child support even if he doesn't work.

    And if I move to the different state now does he have to go there to do it through the court?

    No, he can file in TN and request that the child is returned immediately to TN pending the custody determination.
