Threatening a Judge

My question involves criminal law for the state of: California

I was reading an article online recently about a guy who was accused of rape, then while he was out on bail he raped someone else. He was then let out on bail a second time. Here is where I did something stupid. I posted that "If the guy rapes a third time, the judge needs to be dragged out into the street and shot."

I never meant to threaten anyone, but I think I just committed a felony threat against a judge. I cannot delete my post and I soooo regret posting it. I don't know who the judge is. I live on the other side of the country, but it is a newspaper for a county I used to live in. My adult daughter lives in that town.

I am beside myself worrying that I will go to prison for this stupid internet posting. I can't sleep.

And how many rape convictions does this man actually have?

None...he was accused, arrested, then let out on bail. He was then accused and arrested again, then let out on bail again.

I'd be more concerned about a possible defamation action at this point.

You've basically stated - without any convictions - that he's a multiple rapist. And that's not legally correct at all.

I'm less worried about a civil action than I am about a criminal action. Forgetting about the "defamation" for a moment, should I be worried about what I posted as my main concern?

I doubt anyone could take your post as a serious threat to the judge. I wouldn't stress about it. People say much more vicious things about political figures every day.

The "alleged" rapist, however, should probably be taken out and lynched. I'm surprised bail was permitted the second time around ... I wonder if there were some unusual circumstances that existed to permit that?

Thanks for the peace of mind. The alleged rapes were two/three months apart, so maybe the information never got around yet from the first one.
