    Trespassing Ordinance Violation
    My question involves criminal law for the state of: MO


    I was arrested for trespassing with no priors. The ticket was marked ORD not RSMO. I was booked and served 24 hours. I had a court date on Aug 26 and got a continuance and have a new court date coming up. I have the option of pleading guilty or not guilty. I want to plead not guilty but am worried about the outcome if I lose. One attorney I spoke with mentioned a max of 6 Mos in jail. Is this for real???

    I cannot afford an attorney.

    If the ordinance you violated carries a maximum penalty of six months in jail, then the maximum penalty is six months in jail. Absent highly unusual circumstances, you're not going to go to jail for a first offense simple trespassing charge.

    You are free to inquire with the court about your eligibility for a court-appointed lawyer, and to petition for one if you qualify (or to have the judge make that determination).

    You or your lawyer may attempt to negotiate a plea bargain with the prosecutor. Depending upon the full facts you may be able to get diversion, a deferral, or some other more favorable outcome.
