I Was the Victim But, I Was Arrested
My question involves criminal law for the state of: Michigan

A few nights ago, I was assaulted by my 20 yr old daughter. She is a recovering drug addict who had relapsed and beat me severely enough to give me a concussion, fractured nose, black eye and severely swollen face. When I tried to call 911, she took the phone from me and called herself stating that I had assaulted HER. I was arrested and charged with Domestic Violence because she told them I started it. I spent 10 hours in the jail and was never offered medical treatment. I basically just slept while I was there, altho I was also vomiting extensively.

I now have to go to court and I am trying to figure out the best way to fight this. I have taken daily pictures of my face to keep a record of my healing, I have the Emergency room report stating my injuries. From what she has told Family members, her only injury is a swollen hand.

I have had no contact with her,(My choice, altho it is also court ordered.) I am not even sure where she is.

Is there anything else I can do? I am planning on getting a court appointed attorney.

Had you been drinking? That might explain why the officers were not inclined to believe your account of events.

In any event, that attorney would be a great idea. You might also want to seek a restraining order keeping her out of your home ... assuming you are not living in HER place.
