Malicious Mischief
My question involves criminal law for the state of: Michigan
Yesterday, i was in royal oak, mi walking home from a bar I was ticketed for malicious mischief for placing garbage cans in the roadway and walking away. Within 2 minutes officers tracked us down and we were questioned. I owned up to it and the officers instructed me to return the garbage cans, which I cooperated fully. no property damage occurred. I am in the process of becoming a cap, so i am concerned about the implications of a misdemeanor for this crime which seems fairly serious compared to a simple civil infraction.
I was instructed by the officer to plead not guilty and pay the fine. Should I consult a lawyer? What type of fine am I looking at? Is there any way to reduce the charge? I am just looking for some direction to reduce the severity of such a dumb, drunken act.
Thanks.

Re: Malicious Mischief
Get a lawyer.
Get into AA.
Placing trash cans in the road....you could cause a car accident....whether it be minor or even fatal, when someone either hits those buckets or swerves to avoid them.

Re: Malicious Mischief
I understand it was a dumb thing to do. It was a very dumb thing to do. I had no intent of injuring anybody and did not come on here to be scolded. But for it to be considered a misdemeanor (same as a DUI or OWI?), I just think is a bit excessive as I had made the most responsible decision by walking two miles home rather than driving though I had transgressed on the walk to be an idiot. I am asking for advice: Would it be better to plead not guilty and pay a fine (as the officer instructed me to do) or should I hire an attorney? Will I be able to plead it down to a lesser charge?
I appreciate any help you can offer as this is the first time I have ever been in a situation this serious.
