Ex-Wife Threatened to Not Pay Her Car Payment
My question involves collection proceedings in the State of: North Carolina
I co-signed my ex-wife's car when we were married and obviously understand if she doesn't pay they come to me and all that good stuff. My question is, I have a text from her that says she will not pay her car payment unless she stops getting bills from the IRS about taxes we owed together when married. They were filed under he SS number, that's why the bill goes to her. I have a payment plan set up and the IRS end is totally taken care of. I guess she just doesn't understand that part. If she doesn't pay her car payment will the text threatening me not to pay it hold up anyhow?
Re: Ex-Wife Threatened to Not Pay Her Car Payment
What do you mean, "Hold up"? Hold up for what purpose?
If the divorce judgment requires you to pay off the tax debt, pay it off. If the divorce judgment requires her to pay the car payment and she does not, you can seek to enforce the judgment - but depending on what the order says, obviously it will help if you're not in contempt, yourself, for failing to pay off the tax debt.
