I Am a Sex Offender Seeking Custody
My question involves a child custody case from the State of: Michigan
I am a registered sex offender in North Carolina. I have a 4 1/2 year old daughter who lives with my ex-wife in Michigan. I was convicted of indecent Liberties with a minor (6 y/o daughter of a friend) by a military court-martial. I spent 4 years in a military prison and went through 2 and a half years of SO treatment. My question is can I possibly get joint or partial custody of my daughter? There have been two DCS cases opened against my ex while I was incarcerated (one in MI and one in NC). She refuses to even let me see her or even tell her about me. Even if I had visitation, we are too far apart for regular visitation. I have completely turned around my life and I just want to be a part of my baby girls life; I want her to know that I didn't abandon her. I have a full time job and I am in a steady relationship. Thank you.

It would be quite unusual for you to be awarded custody of your daughter, given your sex offender status, but you may well be awarded some sort of visitation. You need to have a chat with a Michigan attorney. This is definitely not a DIY project.

Even if you lived close to Mom, you'd have virtually no chance of getting custody - of any type - of your daughter. You may still be able to get supervised visitation though (which may eventually turn into unsupervised visitation).
Dad, you should really also check to see if you actually still have your parental rights.

I do still have my parental rights. We were divorced while i was still in the brig so I got screwed with the divorce. I couldn't counter her arguments even though much of what she said I have proof (mostly photos) that she lied. I tried to write to the judge and it was returned saying that if I wanted to add anything or counter argue something that I would have to get a lawyer. But being locked up in California with NO income and no access to legal aid I was kind of SOL.

It's not about the divorce - it's about your SO status.
That's not in dispute, correct? That is why even if you argued, Mom would likely have gotten her way anyway. I'm assuming she has sole legal and physical custody? Well, without an attorney you really don't have a chance at changing that and even WITH an attorney I doubt it will change (because nothing has changed in your child's life - and that's the key here).
