    Trying for Hardship Waiver After Deportation and Getting Caught in the U.S. Illegally
    My ex-husband was deported back in 2001 for statutory burglary and was barred for 5 years. He returned illegally last year and was caught a month ago trying to get a driver's license with a fake SSN (with his own original SSN number). Now he is trying to fight his immigration case claiming his life is in danger if he goes back to his native El Salvador. He has 2 kids with me here (both children US citizens) and one child with another women (also an illegal with a US citizen child). My question is what are his chances of being granted the hardship waiver? Will the charge of using fraudulent identification hurt him? Will having children here help him? It didn't help us before when he originally got deported.

    Unfortunately, none of the things you have noted will trump an illegal reentry and/or trying to obtain a government ID with a fraudulent SSN.

    Since he was in El Salvador for 10 years before returning, what has changed recently that puts his life in danger?

    I'm going to be brutally honest with you, OP.

    He was deported once and barred. He then re-entered illegally, and was caught breaking the law - again.

    There is an incredibly strong chance he will be deported and barred for life; he has shown that he has absolutely no respect for US laws.

    children here won't help him...the gov't will say the kids are best off w/o the father.

    Thanks for the replies. Honestly, I'm perfectly fine with him not being allowed back however, I know he will just try to re-enter illegally again.

    He claims that the gangs in El Salvador were threatening him and that is why his life is in danger. He's lost several friends down there. Apparently they aren't too nice with deportees.

    My only reason for wanting him to be legal here is for child support purposes. Again, thank you for the responses.

    So unbelievably, he got the case dismissed against him (the one regarding the fraudulent ID) so now does that mean his chances of beating this immigration thing are better? He no longer has the charge of Identity fraud.

    Also, the lawyer keeps asking me to supply his prior criminal record. why can't his lawyer obtain this information? He is basically telling me that without his prior records he can't help him but yet as his lawyer he cannot obtain these records? Does this seem fishy to anyone other than me?

    It seems like his chances of fighting deportation are getting better doesn't it?

    It costs money for the lawyer to do the research. Why would you not assist him?

    He re-entered illegally. It is likely simply a matter of time before he is deported, again.

    Quit making excuses for your ex.

    excuse me you JERK. i did not make exuses for my ex and if you read my entire thread, i WANT him deported so keep your judgemental comments to yourself.

    I didn't say i didn't want to help i just wondered what he is paying the lawyer for. You are a true jerk.
