My question involves collection proceedings in the State of: Indiana
I put my name on a cell phone contract for my husband's cousin, and they started paying it and then was unable to continue paying it, but instead of communicating, they did not inform me and it went to collections. When asked about the overdue bill on Facebook by my husband, the cousin said that they had agreed to pay for it. It has been a year since they stopped paying, and after a couple of months he would retrieve the collections notices from the grandparent without permission, and just recently I had stumbled upon a bill that he had not come after. Since we had a verbal agreement that he would pay for the phones because they were for him and his wife, and my husband nor myself had received any benefit from the purchase of the cellular phones, am I able to sue him for breech of a verbal contract, and would it hold up since I have a message that he had agreed to pay for it?
