    What Can I Do About a Summons I Received 2 Months After Court Date
    My question involves collection proceedings in the State of: Mississippi
    I recently received a summons from a collection agency on past due credit card bills. The summons was dated July 11, 2011, I did not receive the summons until Sept. 8, 2011. I have no money except a CD. Can I authorize the company to take it from the CD and just go away? I am frightened to death over this and everyone I have spoken with keeps telling me it is too late to do anything. PLEASE advise me.

    You can seek to have the judgment overturned (if there is one) on the grounds of improper service.

    How old is the debt?

    Around 2 years since I made a payment. The textile plant where my husband worked for 25 years closed. He and I both work but we don't make anywhere near what he did before and couldn't afford to pay even the minimum. I can't get to the CD. but if they could just take the money from there and leave me alone I could live with that. Thank you for answering so soon.
