Adopting My Niece and Getting A B-2 Visa
My husband is a US citizen and I am a US permanent resident. We want to adopt my 2-year old niece who still lives abroad now. We current reside in Virginia. I have several questions:
1) Have then been successful case in getting B-2 visa with a baby? My brother has visited the US one time in 2001 on B-1 visa and have good job, expensive house and etc. We want to invite him and my niece to visit US for Thanksgiving. Will the Consulate grant a visa to my 2-year old niece together with her dad?
2) If my niece came over on B-2 visa, we would keep her here after her dad returns. Will she then be illegal? Since she is less than 16, I assume after 2 years of living with her, I can then apply for GC for her?
3) How does the adoption process work? Should we complete adoption papers in China or here in US?
4) If she cannot get a B-2 visa to come into the US, what other ways are available so we can adopt her and bring her to live in US legally?

A B2 visa is a tourist visa. Tourists frequently travel with their children. More details here. As should be obvious, getting a tourist visa does not give you the legal right to leave your children behind in the United States when you go back home.
Consider working with an adoption agency which handles international adoptions, or consult an immigration lawyer.
