If My Ex Is Behind on Support, Do I Have to Let Him See Our Child
My question involves child support in the State of: Alabama

    2 parts.

    1. I was wondering if it is at all possible to stop child support.

2.My ex-boyfriend pays $50 a month out of $300 (if that). He expects me to bring my daughter to him for him to see her and for him to get to have her for weekends and such. Before my daughter has maybe seen him 5 times. If i keep not letting him see her can anything be done about it ? I am fine not getting the child support, but if i just kep collecting <50 a month do i have to let him see her. (btw she is 2)

I don't think it matters what State you live in, but keeping your child away from their father is a BIG NO NO in court. You should not allow your differences and child support to determine whether or not the other parents sees their child. It should be compromised on both of your parts as to whether who would be picking up the child and dropping the child off for visitation. My advice to you: DO NOT keep your child from seeing the other parent simply because of child support issue. Should he take you to court, your chances of the judge favoring your decision would be extremely minimal. Courts don't like it when visitations are being denied simply because of child support issues.

    1. Yes...it's possible.

    2. Are there any visitation orders in place?

No there are no visitation orders in place. I do not have the money to be driving my daughter to go see him and he does not have the money to come see her.

If there are no visitation orders in place, you are not obligated to let him see the child (you should, anyway. Children have a right to both parents, even if the parents hate each other.)

That said, he can drag you into court to pursue visitation, and he WILL get it.

Child support is a separate issue entirely.

You can tell him that he is welcome to come and visit her but that you can no longer afford to drive her to him as frequently. (That being said, it is in your daughter's best interest to have a relationship with both parents and if you and dad can work together to solve this problem it is much better for her.)
