    Will being caught crossing stop a fiancee visa?
    My Mexican fiancee tried to cross the border, but was caught (they took his fingerprints and he stayed over night in the jail) so he went back home.

    I want to apply for a fiancee visa, but I am very worried that because he was caught trying to cross the border illegally one year ago, that this will get in the way of obtaining the papers we need to bring him here and get married. Should I do something before filling out all the papers for the visa? Does he have a ban on him?

    I am going to go to a lawyer again, but wanted to know what the chances are of being denied.

    Just wondering if anyone knew what to do, or had gone through this before.

    Have him inquire with U.S. Customs and Border Protection to see if he is subject to a period of exclusion from the country. My cynical guess is that he is, and he already knows the terms of that period of exclusion.

    He said that they didn't tell him anything at the time they caught him about what the restictions were- or he wasn't paying attention (we didn't make plans to marry until now, so he didn't think to ask).
