Refund Fraud, What am i looking at?
Hey, first time poster to these forums. ill admit, i did someting very stupid. i worked for sears and committed refund frauds, basically having some one buy items and then i would "return" the item with it not being there. anyway, i was caught by someone turning me in. I spent the night in holding at the local police. items valued were about $2100. However, when talkin to Loss Prevention, they told me if i cooperated and repaid what i had taken, there would be no legal action. I cooperated fully. filled out a statement, and signed a promissary (sp?) about paying back the money in full. However after all that, they still called the cops. im 21, this is the 1st time i have ever been in trouble with the law. Judge let me go w/ out bail, and i have a court date in Oct. What am i looking at as far as punishment? first time offender, and i did sign the promissary to repay everything.

also, while in the LP office, they did take my keys to my car and got 2 of the cameras back, totalling about $600.

Well, I don't think that since they had to take your keys to retrieve the stolen merchandise, that this matters, sorry. I can't say however, that loss prevention had any rights to do that, and that maybe they should have let the police handle that part. That may be a seperate issue, and may not effect your sentence.

my promissary is to pay $300 a month, what if i pay more, like $600 a month, would the judge take that into consideration?

The judge will probably consider the effort you have made to pay off your restitution.
