Can I Apply for School During Adjustment of Status
My question involves marriage law for the State of: New York
I came in the country on a tourist Visa B2 and married my boyfriend spontaneously. We are filing the petition now for the adjustment of status to get a green card. I was a student back in my country and it is very important to me to continue my studies here in New York.
My question is: Can I apply for school and attend school while waiting for my green card? Or do I have to wait till I get my green card and then apply for school? That can take up to 8 months, but I really would love to start school coming January.
And what about the tuition? Do I pay the same tuition like US students or do I have to pay more?
Thank you for your help and legal advise.
Ina
Re: Can I Apply for School During Adjustment of Status
You cannot get a student visa while your I-485 is pending, at least not without abandoning that process. If you enroll in school, you will not qualify for federal student aid while your I-130 and I-485 remain pending. You will have to pay whatever tuition the college that accepts you charges for students in your situation - you can check and see what their requirements are, assuming you're applying to a state university, for eligibility for in-state tuition. I cannot promise in advance that no school will want evidence of your status, but many colleges accept undocumented students.
