Can the Courts Force My Children to Go
My question involves a child custody case from the State of:Texas. My childrens father has been out of their lives for 5 yrs due to his drug abuse.He is 30,000 behind in child support. he just recently filed for enforcement ofvisitation to see the kids the situation is that my now 13 yr old has told me some disturbing things that he did around her when he was in the house hold while I was at work. She stated to me she would catch him watching nasty movies and playing with himself and when he would see her he would make her go into her room. She said he would take her and sit her on his lap while he would be in his boxers and in the front where the opening of the boxers were she could see his private. he would make her really uncomfortable when she was around him. he once took her with him to some guys house where she described white powder on the table and guns. My heart sunk when she told me this. She is now 13 but she remembers a whole lot. I feel really hurt because she said she disd not tell me because she thought I would be mad and sometimes he would tell her she would get a whipping if she told me. I hav 2 other children 10 and 7 but they dont know this man. My now husband has been the father in my kids lives and he would like to adopt them. The problem is whe have court on sept 7th and I dont know what to do. I had to press charges against him for harrassing me and he went to jail an he still is. I have written a letter to the DA based on what my daughter has told me and she is scared that the courts will make her go with him and I dont want to be found in contempt of court because of this. i believe what my daughter says but i dont want to make it seem like we are making this up. want to protect my kids. please what do I do. I am afraid he may retailiate. He is trying to enforce visitation.

Please explain what happened when you reported this to child services.

I have not I just recently written a letter to the District Attorney reguarding this. Should I contact child services

I'll be brutally honest with you. The timing of these allegations could be viewed as extremely suspicious. Dad files to enforce visitation and suddenly he's accused of molestation? Yet not a word was heard about this until after he filed?

my daughter just recently brought this to my attention when I told her he would like to see them and thats when I wrote the letter to the Da and she wrote one as well. Im really stuck in a situation. She said he did not touch her but it was the things that he did around her and in front of her that makes her uncomfortable.

We have not heard from him in 5 years we thought he was some where on drugs. But all of this is new to me and I dont know what to do or should I just give in and tell her she has to go

You can respond to his request by asking the court to order a supervised period of phased-in visitation where Dad and the kids (it's not clear whether the other two are his or not - I'm thinking yes, but please feel free to correct me) are reintroduced.
You can also contact CPS and/or the police and make a report based upon what your daughter has told you. The outcome of any investigation could impact Dad's visitation greatly.

All three of the children are from him my 10 yr old has a learning disability and I have a 7 yr old son but they do not know him. He left when they were small only my 13 can tell what she saw and things that he did. Im not saying he molested her but she told me would the court even look at this. I have already written to the Da on this do you think they will respond to this.

No. The DA isn't going to do anything. You need to make a report to the police and and CPS.
Please tell me that the kids do actually know that your husband isn't actually their father though.

First and foremost my two younger kids they dont remember him at all. My 10 yr old has a learning disability and for the past 5 yrs all she has known is my husband.My son was 3 when this man left and my husband is all he knows. This man will be a stranger to them. I have even shown them pictures of him and they dont know who he is. Why would I tell them about a man they dont even know. My hus band has been financially taking care of my 3 children for the past 5 years he even had them on his health insurance. They would not understand especially my 10 yr old who has the disability. if this man wa to come into their life it would emotionally and psychologically tear them up. I have spoken with Cps and they are investigating the letter my 13 yr old wrote to the court. He has said I failure to disclose my address when I have a letter that he wrote to my house. He has stated that he has come to my home and was denied his visit when I have documetation that when I filed that he threatened to kill me my husband and take my kids. My husband is always home when says the times he claims to have come by and if thats the case the Pd where I live would have been notified like they told us to if he comes by. I even have a copy of the protective order that was given. he is so ignorant. How could he have been to my home on these days.
