    Mutual Contact Within a Restraining Order
    My question involves restraining orders in the State of: California

    My boyfriend and I had a domestic dispute a few months back. He was charged with a felony and a 3 year restraining order was put in place. We plan to discreetly continue our relationship (please no lectures) , but if we ARE caught, we would like to know what could happen.

    He'll be brought up on contempt of court charges, and whatever jail sentence he would have received had he not been granted probation will be imposed.

    I believe he was convicted of terrorist threats and assault. Really... the little don't do that comments are a waste of time. We're both grown adults who have made a decision. I'm simply looking to educate myself and my partner a bit further on said decision. I have been in just as much contact if not more... that wouldn't make any difference in the eyes of the court?

    He will be subject to mandatory arrest as this is the ONLY crime in CA that mandates an arrest where there exists probable cause to believe it occurred. He will almost certainly go to jail.

    He would be a fool to do this, and you would be a bigger fool to re-kindle a relationship with him after he thumped on you.

    If the two of you have any children together, you can expect CPS to seize those children should you allow him back or continue the contact.

    It really hurts your credibility, and your participation won't affect the outcome.

    If you go ahead with this relationship, he risks going to jail. Period. It really is that simple. So choose wisely.

    You're both grown adults who have made the utterly stupid decision to disobey the courts.

    When the court says NO? It's NOT a suggestion.

    The don't do that comments are net meant to be chastizing, they are warning you not to disobey the judge.
