How to Change a Child's Surname from Ex-Husband's to Biological Father's
My question involves name change laws in the State of: FLORIDA
I have a 3 year old daughter whom i gave birth to in the state of kentucky. i now reside in the state of florida and the biological father signed her birth certificate.since i was married to a man who is not the biological father (not the man who signed the birth certificate), here in the state of florida the man i was married to is the legal father of my child even tho hes not the biological father.i would like to know how i can change the childs last name from the biological father even tho hes not the legal father,to my last name.the legal father wants nothing to do with the child and neither does the bilogical father therefor i would like for my child to have my last name.:confused:

You've lost me. How did someone other then the biological father who is listed on the birth certificate not be the "legal" father?
How was that accomplished? If there was an adoption done, then you really should have addressed it then.
Generally the father's (legal) name is used.

where did you reside when the child was born? Paternity is established in the state the child is born. Florida would not control the determination of whom the legal father is.
To change the name of your child you must have permission from the legal father unless a court determines the child has been abandoned by the legal father and it is in the best interest of the child to change the name.
