How to Determine Self Employed Income
My question involves child support in the State of: TN/CA CP lives in TN, OP in CA
If OP is self employed (has his own business although it is unlicensed) and refused to submit proof of income to the court, how can his actual income be determined? Since he refused to turn over any info, his income was calculated at minimum wage but he makes considerably more. None of the income he makes is reported to the IRS so that route won't work. Thanks for any ideas.

He doesn't report the income so no tax returns.

Get whatever records exist and use those. Or hire a forensic accountant to project income and see what he comes up with.

there are zero records. Everything is done in cash. Can/would the court look at his expensive house, multiple cars and multiple motorcycles and realize he can buy all this with zero income?

You, your lawyer, your investigators and accountants can look at whatever evidence there is, and try to use that evidence.

And bear in mind it wouldn't be difficult for him to claim that someone else - girlfriend, new wife, parents, relatives - gifted these things.

so he can actually just keep working under the table and never be responsible for the child support. That is what I thought but had hoped maybe there was some other way. Thanks for your advice

Most people who work that way usually puts items like house, cars, and motocycles for examples....in someone else name so it makes it really a lot harder to track the person worth or net income.
