Statute of Limitations on a False I.D. Charge
My question involves criminal law for the state of: Alabama
A bar confiscated false identification (driver's license) with my real name and picture, as well as address (xxxx Joe Street) (different city and state than my real address). I don't know if they will turn it over to the police, but my questions are: 1) How long do they have to turn it over to the police? 2) How long do the police have to press charges? 3) If the police press charges, is it likely to be a Class 1 misdemeanor, or something else?
I am 18 y/o, and from VA.
Thank you.
Re: Statute of Limitations on a False I.D. Charge
I'd be looking up a good lawyer in the county in which that bar was in. Most bars will forward the IDs to the ABC to avoid having any risk to their license.
Alabama doesn't have "class 1" misdemeanors. They use letters in their classes.
There's no set time on the bar turning you in. The state has a year from the time you committed the crime to charge you. That time may be extended since you are out of state. The penalty for a fake id can be up to $500 (plus costs) and up to three months in jail. You'll have a criminal record. Your driving privs in Alabama will be suspended for six months. It will take another $275 to clear that when you're done. Fail to do that may make it impossible to renew or obtain a license in Alabama or any other state. Probation and community service are options.
