    Help! My husband is divorcing me in Rhode Island. I also want the divorce and thought both of us had come to an agreement, but nothing is in writing. He lives in Rhode Island, and I have moved to California. I jsut found out that he has not a)paid the bills he promised to pay b)not cancelled the phone he said he would c)filed individual 2005 taxes, instead of filing the joint 2005 form he had promised to file. In addition, his lawyer served the papers to me later than we agreed, and I keep being assured by his lawyer that I do not need to either answer the court or contest hte claim, and simply need to mail him a letter with what I want so we can come to a marital agreement. I find this fishy.

    I feel I am being "railroaded" into the divorce and that my requests are unlikely to be heard, considering my soon-to-be-ex's previous behavior. Can I include my previous request in the marital agreement, and what are my rights if I am unable to file a claim before hte 20 day divorce response time? The back taxes I know owe are about 2400. Had we both filed jointly both of us would have had a small (about 100 dollars) refund. What is the likelihood of getting my spouse to pay the taxes if I take him to court?

    You need a lawyer last year to represent you in this lawsuit.

    So much for working things out amicably. Do you have any recommendations. I live in California, but he filed for divorce in Rhode Island.

    The recommendation, which I agree with, was that you get a lawyer to represent you in the divorce proceeding, the sooner the better.
