    Divorce What Name Do I Legally Have to Use on My Divorce Papers
    My question involves a marriage in the state of: NC

    I was married in February 2009 and separated within 6 months. I have not moved back in the my husband and have filed for divorce. I never legally changed my name to his name after we got married. My SS number and drivers license are still in my maiden name. When I filed for divorce I used my maiden name. The court date is in 3 weeks. My soon to be ex is now saying the divorce will not be legal since I used my maiden name on the papers. I believe he is wrong. Do I have to use my MARRIED name on the divorce papers even though I never changed my name with Social Security?

    Nope. If you never took his name, you're not required to use it in the divorce papers.

    Thank you. I thought that was the case but he had me second guessing myself. It made no sense to use his name on my divorce papers when I had never used it before. This wasn't my intent when not changing my name, I just didn't take the time to do it after we got married. Lucky me. Now I don't have to go through the trouble of reclaiming my maiden name.

    Yes you are lucky, If you never changed your name then its totally fine. You can go with your maiden name.
