Disorderly Conduct for Marijuana
My question involves criminal law for the state of: PA
My friend and I were at a concert when two officers approached us for smoking a joint. By the time they got to us my friend had put it out and gotten rid of it. However, he also had two joints on him and we gave those up but were searched anyways, multiple times. I had no substances on me but am being charged as well. On my citation it reads, "Defendant was seen in possession of marijuana in the form of a joint which served no legitimate purpose." Can I plead not guilty and get out of this charge seeing as my friend was in possession but I was not?

You can plead Not Guilty, but don't expect to "get out of it", since the officers saw you toking up.
"In possession" does not mean "when the cops finally got there".

But they never had proof what they saw was a joint with weed in it. How do they know it wasn't a hand rolled cigarette?
