Last Month's Rent
My question involves landlord-tenant law in the State of:
I signed a lease in August of 2010 for 12 months, that spans 9/1/2010 through 8/31/2011. I paid some security deposts and cleaning fee, but also the first and last months rent, which was $670 for each month, totaling to $1340.
This was going to be my last month, but I am now going to month to month as of 9/1. I assumed that since I paid my last month's rent deposit, that it would be automatically used for my last month of my initial lease term, which would be August of 2011, this month. However my property manager is saying that it is used for the last month of occupancy ... which to me, doesn't make sense because they wanted to raise my rent if I went month to month, except they didn't give me enough notice, so now they can't do that until the second month.
Basically, is LMR for the last month of your lease term, or does it mean for the actual last month? And on a side note, is your property manager supposed to notify you at all that they haven't received your rent. If she is correct, mine is now 10 days overdue and she is just now notifying me although we have had ample correspondence over the past week regarding whether I was renewing my lease or not.

LMR would be for...
the last month's rent. You do not have a last month until you give notice to terminate your tenancy. The last month of your definite period lease is not your last month of tenancy.
No, they do not have to notify you your rent is due. That is your responsibility to pay your rent on time without prompting.

You didn't indicate your state, and you would also need to check the terms of your lease, but in most states the prepayment of last month's rent means that your last month's rent has been paid even if the rent has subsequently increased.
