    My question involves criminal law for the state of: NC. I found a guitar and amp on the side of the road, they were covered in mudd, I picked them up and put them on my truck brought them home, cleaned them up and put them on ebay, 4 days after my listing 2 detectives came to my home and told me the items were stolen, took down my information left with the guitar and amp. They said they were taking the property back to the owner and that they would be in contact with me. I have since had several people tell me that I can be charged with possession of stolen property, I did not know it was stolen if I had I wouldn't have put it on ebay and I would have called the sheriffs office. Can they charge me with this? If so what do I need to do at this point?

    NC statute says you have to know or reasonably should have known the items were stolen. You could always be charged. Will you? Who knows. I'd recommend if the police come to talk to you further that you consider having a lawyer present before speaking to them. Just because things were on the side of the road do not make them finder's keepers for whoever passes by. You knew those items weren't yours and it's not like you pulled them out of a dumpster.
