17 Year Old Pregnant with 17 Year Old

My younger cousin is 17 going on 18 in March. She is 4 months pregnant and her boyfriend is 17 and now lives in Colombia. They lived in Canada before and her mother kicked her out after beating her so she lived with her boyfriend and his family for a month before her mom reported her as kidnapped. She then sent her to NY ,where we are currently, where she found out she was pregnant. Her mom(lives in Canada) gave me custody of her except the right for me to allow her to leave the country obviously in the situation where she could go to Colombia marry her boyfriend or live with her father whom does not have custody of her! Is there anything we can do for her? Can she leave by marrying her boyfriend?Does she has to wait until shes 18?Thank you for your time!

Did her father agree to this?

She sent me a letter that was notarized. Her father would like for her to go live with him.He can not fight for her custody though,

A notarized document does NOT mean that custody has changed. Custody must be changed through the court system.

Please explain also why Dad cannot fight for custody. Where IS the father? In Canada?

Her father is in Colombia and for because of a legal problem he had in the states. Both her father and her boyfriend have agreed that her living over there is what is best.

Her boyfriend has absolutely NOTHING to say about it. Just so you understand.

I seriously think you need an attorney. Perhaps Mom needs an attorney in Canada - because it doesn't appear that you actually have legal custody of the child at all.

Do you believe its wise for us to leave things as they are and let her turn 18? I fear if we start picking at her mom she would make things worse.

That's probably best, yes. That way she can travel on her own, without needing anyone else's permission.

One question. Is she actually here in the US legally?
