International Support Order
My question involves a child custody case from the State of: Wisconsin
What is the likelihood that a support order will be successful internationally? I am currently living in WI with my newborn son and just had to sign papers for the child support agency to go after my fiance to collect child support. This is only going to be a temporary circumstance until I join him overseas, but it would be exceedingly helpful, especially to cover the cost of childcare as I work full time and attend college full time. My fiance is a citizen and resident of France, but also has dual citizenship with the UK as well. I know that WI has reciprocity with France and that the Hague Convention was supposedly modified in 2007 to make it easier for American custodial parents to collect child support from the international non-custodial parent. Realistically, though, do I stand any chance of getting any sort of support from him?
Thank you in advance for your help.
Re: International Support Order
I'm sorry, but nobody can tell you what your chances are. The common answer would be 50/50, but that's pretty meaningless.
If you're joining him overseas though that indicates that you're planning on staying together - is there any reason why he wouldn't voluntarily send you money to support his child? Or are you actually on State aid?
Re: International Support Order
I'm on Medicaid, but my yearly income falls just short of being disqualified for it. (It's annoying, but thankfully after I graduate college I won't be in the system anymore). We tried to take out a temporary insurance policy on him but couldn't as he had a heart murmur. Once I got his BadgerCare card, my caseworker mailed me a form I had to sign relating to child support.
