Emancipation at 16

I live in Florida and am turning 16 soon. I have been thinking about emacipation for a while. i have a few questions but first here is some info:
- i have roughly 5,000$ and a job
- i would live with my mom and pay rent (my dad has custody now)
- i would stay in school and go to college
- i would apply for a couple differeny full time jobs over the summer
- my dad and i are always fighting
- i cry because of that almost everyday
- my anxiety is getting worse being at home
- Etc
Could i become emancipated?
How could i?
Can i without parent concent?
What else would i need to do or get set up before i do to have a better chance?

Emancipation does not mean that you're living with your other parent. It means you are completely self-supportive. You do not qualify.

If your Mom wants to file to modify custody, she can do that.

Florida REQUIRES the parent to file for emancipation - not the child. So if Dad says no, then "no" it is.

Again, you won't be emancipated in order to live with your Mom.

This is not what emancipation means. Emancipation means that you are living ON YOUR OWN and paying all your OWN support. Living with your mother instead of your father is NOT emancipation.

I know what it means. I was also looking for apartments and found some. Even if i found one, i couldnt do this without my dads signature correct?

Do you realize that the vast majority of landlords won't rent to anyone under 18 anyway?

And you're correct - you cannot do this without Dad's signature. He is the one who must file.

Not just your Dad's signature. Your Dad needs to go to court to allow you to be emancipated - and even if he were to do that, you'd still have to meet the court's standards for self-sufficiency.

You: I'm going to stay with my mom till I find a place.

Judge: Don't waste my time till you actually fulfil the requirements, kid. Petition denied - next case?
