Layoff of 23 Employees by County Government After Breaking Outsourcing Laws and Union
My question involves labor and employment law for the state of: NY
Recently let go because of their jobs being outsourced. 23 county employees all the same title.
Union contract is specific about outsourcing (personal contract) This contract was ignored by the present administration. Grievances have been filed by the union.
1. 1993 referendum is very specific that the county exec must have legislature approval (majority vote)on any amount over $25000. County Exec awarded contract for $2.5 million. The county exec has 45 days to refer it to the Rules Committee. This wasn't done.
2. Any outsourcing that cost county jobs must be approved by a majority vote. No vote was taken.
This personal contract was awarded by the county exec 6 months before (January 2011) the legislature got a chance to know about it(July 2011), way over the time allowed by law. As you can see many county laws and regulations were ignored by the administration. The county legislature when voting for this 6 months later admitted that they have no idea what happened and that they felt forced to pay the $2.5 because the work had already been done. Some of the legislators mentioned that this would open the county to litigation. This is all documented in the official transcripts.
What type of lawyer are we looking for.?This civil suit will be class action by 23 former employees. I'm sure it will get much attention in the News. We know that because of the possibly illegal outsourcing these 23 jobs were lost. Much damage has and is occurring in the form of bankruptcy, possible foreclosures, medical and mental issues, credit issues as well as marital problems brought on by all this stress. Any input would be greatly appreciated.

You don't need a lawyer. The union's lawyer will handle all of this. You have to let the union do its thing before you can even think of doing anything yourselves.

In terms of a wrongful dismissal, the type of lawyer who handles the case for the employee is a plaintiff-side employment lawyer. But you're in a union, so your union should be representing you in any ADR or litigation over the layoffs.
