Getting a Green Card

Hi! I will be going to the US this coming October as H1B Visa Holder. My Visa is valid until Sept 2009. From 2006-2009, is it possible to apply for Green Card including my H4 dependents?

Yes. An H-1B alien can be the beneficiary of an immigrant visa petition, apply for adjustment of status, or take other steps toward Lawful Permanent Resident status without affecting H-1B status. During the time that the application for LPR status is pending, an alien may travel on his or her H-1B visa rather than obtaining advance parole or requesting other advance permission from Immigration to return to the U.S.

Thanks for the reply. What are the procedures in applying for LPR without affecting the H1B status? Is the H4 dependent of H1B will benefit LPR as well? What is the normal processing time before you get the approval?

Applying for legal permanent resident status by what means? If you don't even know what you might be eligible for, check the USCIS site and review all the options, or hire an immigration lawyer to evaluate your case.
