Possession of Hydrocodone

My question involves criminal law for the state of: georgia

I've only been in trouble one time before and that was last year when I got a dui. When I got pulled over, this time, I was in a town 2hrs away from home. I was also charged with driving without a valid license.

My po didnt do anything because I've been very good and I guess he wanted to give me a break.

My license will be reinstated next week......my attorney just told me to get my license back then we'll go from there.

I actually have a perscription for hydrocodone just not the strength of the ones found in my vehicle.

Basically, I'm just wanting to know what kind of punishment I'm looking at. I know each situation is different so a general answer is all I'm looking for.

Oh, and I spent 5 days in jail..........if that makes a difference.

Look up the statute you're charged with violating in the Georgia Code.

It sounds like they were not in the pill bottle with your prescription on it. Otherwise, how would an officer know the strength of the pill or even give it any thought. If you don't have the prescription on the bottle and the pills in the bottle, you have broken the law. The fact that you DID NOT have a prescription for the pills in your possessiion, same thing. The fact that you had a prescription for a different size of the same pill is no help, unless you could show the pharmacist give you a different size because he was out of the size prescribed. That would (1) be a very long shot, and (2) would probably cause the pharma to lose his job, so not much chance of that excuse. And driving without a license, and managing to get stopped for DUI, plus you were already on probation or parole, lets just say you are a moron and should follow your lawyer's advice.

Alright, let me ask you another question. If I were to hire you as my attorney what would you feel confident in the end result being........given the above info I provided?

There are way too many variables for an internet board to try to predict your future.

Personally, I think your PO should be disciplined and/or fired for not violating you for possession of a controlled substance.
