Re: Domestic Assault Charges
You need a lawyer. The victim doesn't prosecute you, the state does. The state is unlikely to dismiss the charges in a DV case just because the victim doesn't want to proceed (for good reason).
Re: Domestic Assault Charges
I'm looking for a lawyer now. I was wondering what the possible repricusions are? I know the state is going to prosecute. I don't know anything about the legal system up until this point.. Will their be more than one court date? Or is this next one going to resolve everything?
Re: Domestic Assault Charges
There will be as many dates as it needs to go. If you did something and you are willing to cop to it, you can plead out to the offer. If you fight it, it can drag out. You mentioned having a job in annother state. That can influence your decision too. Are they willing to hold your job until you get this over with. Are they willing to allow you back if you are found guilty.
If you keep your job, they can transfer your case out to that state.
Re: Domestic Assault Charges
I'm just thinking about the loss of income and other ramifications of not getting to Connecticut... In addition yes their was an argument so if their is a plea deal i'd most likely take it. I don't know how this works and I don't want to be tied to Minnesota for the next year.. like if I have to do probation or anything. I made a mistake and I know that, I just hope that this mistake isn't going to screw up the rest of my life.
Re: Domestic Assault Charges
Can't guarantee that it won't screw up your life. Mn is very tough on domestic violence. However, the fact that you are already employed should be enough for the court to allow for a transfer.
Re: Domestic Assault Charges
What kind of punishments are typically given for such a crime?
Re: Domestic Assault Charges
Can't answer that with what you've told us. Mostly supervised probation for a period of 1 -2 years, probation fees, permanant conviction status, court fines, domestic violence counseling(usually for 24-26 weeks,) possibly substance abuse counseling and community service.
