Will Father Get Visits Even After Child Abuse Conviction

    A Child Abuse Charge and Visitation
    To make a long story short, my daughter was a victim of child abuse in March 2010. He father went to jail and awaited his trial. While he was waiting he ended up pleading GUILTY in December 2010. He has recently told me that he is going to try to get visitation with her through the courts of NORTH CAROLINA. What are the odds of him getting any type of visits since he admitted to breaking my daughters legs when she was six months old!?

    Okay, there are issues here.... But if you've got a case in (where was that again?) and he's attempting to open one in another state, he won't succeed in that unless he approaches a Federal court.

    Odds don't apply in legal issues. Every case stands on it's own merits. Given that there was a plea of guilt, that's going to weigh heavily on the court's mind should dad request visitation - he'd be extremely unlikely to be granted anything other than supervised visitation. Whether a request for supervised visitation would be meaningfully considered by the court would be dependent on lots of factors, including the exact circumstances of the incident, any prior criminal record, etc.

    He never told the courts what he did to break her little legs or anything. He just put in a plea of being guilty. He has a major record but this was his first child abuse charge. His other charges are things like bad checks, larcenys, dui's ect. No one currently has custody of her but I am going tomorrow and filing.
