Does a Mother Have Rights to Her Children if She Left Them Over Five Years Ago
My question involves a child custody case from the State of: Arkansas

The mother of my 2 kids left my kids over 5 yrs ago... She was on drugs & took off across the U.S... Me & my fiance have been taking care of them ever since. She hasn't paid any child support. She started calling the kids (when she remembers them) about 2yrs ago... I'm wanting to know if bc she's done nothing for them in almost 6yrs & hasn't made any effort to visit, does she have any rights to my kids?

Yup. They are her kids, too.

She can go to court and file for visitation/custody. It will start out slowly and supervised, but the mother's wishes to be a part of her children's life will be protected.

As the custodial parent, you should be encouraging this contact... not fighting it. At one point, you believed this woman to be the perfect mother of your children....time to step up for your children.

So far as the courts currently see it, absolutely. And consider it from her position: sure a lot happened between you two, but she understands what matters in life now and wishes to live.
