Can I Break a Lease if I Haven't Moved in or Payed the Security Deposit
My question involves landlord-tenant law in the State of: Ohio
I found a place I would rather move in to but i already signed a lease with a move in date of september 15th. It is now july 7th. I have not payed a security deposit yet and i received a call from my land lord saying that if i did not pay it they would put the apartment back up on the market. Since i do not wish to live there and they already threatened to break the lease if i did not pay the security deposit, can i legally break the lease without being responsible for the rent?

If they find a new tenant by your start date, then you aren't responsible for the rent. If they cannot, but are making an appropriate effort to find a new tenant, you're responsible until they find a new tenant. So if you're not planning on moving in you need to stop playing games and let them know, because the delay you are causing can cost you money.

I'm not playing games. they knew i was not interested and put the place up on the market before i even posted this. i was only asking if there was a way that i could legally not be responsible for the rent if they didn't find a replacement since they threatened to break the lease.

1- YES if you signed a lease, then then can hold you responsible if they DON'T find a replacement.
2- If you DIDN'T pay the deposit, they had to find a replacement because you didn't follow through, then YOU are the one who CAUSED the lease to be broken, not them.
3- And YES, if you don't pay a deposit, MAKE THEM cancel the lease, then say "look, they cancelled the lease", then you are playing games.

i could have sworn this was a forum about laws. i remember asking about a law and if there was a way i could legally do something. i don't remember asking for opinions on what i'm doing or if i'm playing games or not. so for all info about the law thank you.. for everything else... blow it out your ass
