    My question involves a child custody case from the State of: Kentucky

    My wife took my child to another state almost two months ago on a Friday after I got home from work and told me she had a attorney and was going to file for divorce.

    That next Tuesday I filed for Divorce and put in a motion to have my child returned to Kentucky. My wife was given a signed order to return our child to Kentucky.

    Here is my question. The order said that if she returns and live in Kentucky then she would have Primary and I would have every other weekend and one weekday overnight, but if she moved out of state then I would have Primary.

    Well last week she returned with our child ,when I went to pick up our child she told me that our court date should be in a month do I want to keep our child until then, I of course said yes, seeing I have not seen my child for about a month and a half.

    The next day she got her stuff and 95% of my childs stuff and moved back out of state, leaving me with our child (I am happy about that). She took all but 5 pairs of shirts, pants and shoes, she took all my childs favorte toys. I had to buy all new toys and things for my child to wear.

    Because she left and moved out of state, she gave me Primary right? And what are her chances of getting Primary now and the court letting her move our child out of state? She did try to file a motion asking for her to get Primary and let her keep our child out of state, however the judge did not sign it.

    I know this looks better for me, just wanted see if this is as good as I think? I have a good attorney just wanted to get another take on my issue.

    When you posed your question to your attorney, what was the answer?

    Your attorney is your best source of information about your case. S/he is a professional and you're shelling out hard-earned money for professional advice. Educated laypeople on the internet are not going to be better than a pro, and our opinions have no bearing on your situation in any case. Just listen to your attorney and keep doing what's right for your Munchkin.
