Wrongfully Ticketed
My question involves a speeding ticket from the State of: Oregon
I was on I-5 in Salem Oregon in the center lane and a car was passing me when the cop pulled his radar gun. I had my cruise control set at 62 Mph in a 60 Mph zone and the cop pulled ME over and gave ME a ticket for going 75 in a 60 and he let the other guy get away! This was not me, I wasn't speeding! It was the car passing me but the cop wouldn't listen to me. How do I beat this? I know the speed there is 60, I was ticketed last year about the same time and have watched my speed in this area ever since. The last time I admitted I was speeding because I know I was, this time I wasn't! My wife was in the car and saw the speedometer and she agrees we were doing about 62 or 63. What can I do?

Re: Wrongfully Ticketed
Contest the finding. Either get a lawyer or go pro se. You may have to read some books and learn a bit about Oregon Traffic law if you choose the latter, but if you have the time it's definitely worth it.

Re: Wrongfully Ticketed
Well, I know in WA courts if you say you were doing 62-63 the judge will say something along the lines of "you were still speeding". Contest it and request discovery. Post what you find.

Re: Wrongfully Ticketed
If the speedo said 62-63 you may actually have been under 60! If it is a BMW I'd guarantee that.
You get tickets for MOVING at a particular speed, NOT because the speedo indicated some speed. DO NOT get so caught up with what the speedo said and that that means you were speeding. If it gets to testimony, you can figure a way around this.

Re: Wrongfully Ticketed
Yes, what the OP's speedometer read will likely be seen as junk anyway unless its a new car and the OP can find the NHSTA/other reference .
