Caught Shoplifting in Florida
My question involves criminal law for the state of: FLORIDA.
Hello, This past tuesday I was caught shoplifting with 2 friends of mine. One was left go with a tresspassing paper, as were we. Me and My other friend on the other hand were arrested.
-We are on each others Police affidavit. It's listed as Misdemeanor on the police report, I had 75$ worth of stuff on me, he had under 125$.Now on the daily booking site it said Misdemeanor 2ND degree pettitheft.
-How do I know if we were combined the total worth? or just what WE each did?
-I have a clean background never did anything wrong.
-What Can Happen? is there anything I can do? I've tried calling those attorneys that send you papers in the mail to help me out, and there really high in price, and my friend told me that most are a scam and are just trying to freak me out.
If someone can please help me out, that either been through this or knows about any of this, it'd be appreciated.
Re: Caught Shoplifting in Florida
You would benefit from a Criminal Defense Attorney. Who may be able to get you into a Diversion Program or some First Time Offender program. Or the charge reduced.
Find one through the Yellow Pages, not a mailed flyer.
Yes, the store can combine the total items stolen, since you were together.
Re: Caught Shoplifting in Florida
I have a question, im going to try to figure how to word it so you can understand as well everyone else.
ON the police report it says Misdemeanor *daily booking site: SECOND DEGREE misdemeanor*
Some people are saying that in court/arrangement that the charge can change, can it change to another degree?
ALSO:
if they believe that my friend has stolen another time in the store but didnt catch him and i was with him, can that be brought into this, or is it just this, since they didnt actually catch him stealing.
Re: Caught Shoplifting in Florida
You and your friend are being charged separately. If the store thinks your friend stole before, and can produce evidence (video, for example), then they can use it against your friend in his case.
The charge can be changed by the Prosecutor, usually a downgrade. Or you can be offered a Diversion Program, or a Plea Deal.
