2.5 Year Old Probation Violation Plus Two Bench Warrants
My question involves criminal law for the state of: Florida
Im 27 years old and was put on probation in Feb of 2009 for a 2nd degree misdemeanor. I completed 2 months and then gave a dirty urine. I got scared because I didnt want my 2 dogs to go to a shelter so I came back to my home state of NY. I missed to court dates in two other FL counties for traffic court so now I have 2 bench warrants as well.
I have been here for 2.5 years and haven't gotten into any trouble I am now 3 months pregnant and in school Id like to deal with this before I have my baby in Jan. I cannot afford to go to FL to turn myself in I also dont want to miss school because this school goes by hours not credits is there anyway of dealing with this without going back to FL I obviously stopped smoking as Im pregnant I just want to do the right thing and fix this mess so my child can have a good life and I dont EVER have to miss a day of it Id be willing to do 5 years probation if it could just be here in NY.......btw its only pot I was smoking Ive NEVER done any other drugs..........any help much appriciated.
Re: 2.5 Year Old Probation Violation Plus Two Bench Warrants
It will be up to the authorities in FL as to whether or not your probation can be transferred. We have been hearing more and more stories of jurisdictions refusing to add out of state probationers to their roles.
Doesn't mean it won't happen. It just means it isn't the slam dunk it once was.
You have three outstanding warrants... this won't go away. You need to talk to a Florida attorney immediately.
Re: 2.5 Year Old Probation Violation Plus Two Bench Warrants
Is it true that a public defender wont do as good of a job as a private attorney??? ....... I have spoken to lawyers they all want 1500 and up to "file motions" plus I still owe 1500 in court fines......Im going to school to enter into the medical field but right now my job only pays me 200 a week which doesnt even pay all my bills
Re: 2.5 Year Old Probation Violation Plus Two Bench Warrants
No, that is a myth. Any lawyer is going to do the job they swore to do, if they value their job. You made some bad choices and now you have to face consequences. They may be willing to transfer your probation or they may have you serve out jail time for the offense.
Re: 2.5 Year Old Probation Violation Plus Two Bench Warrants
Will I get any leniency for being pregnant?I want to take care of this before the baby is born. I'm just so short on extra money I also live in NY alone and will lose everything I have .....its a 2nd degree charge and it was 6months probation........also can I pay my fines before I turn myself in. Maybe that will get me more leniency I'm a nice italian girl I really don't wanna ha e my baby in jail or have her suffer with three months without me after she's born.
Re: 2.5 Year Old Probation Violation Plus Two Bench Warrants
Being a nice Italian girl has no more bearing on things than being a bad Pakastani. The bottom line, is that the judge can take whatever he or she wants into consideration. Your prior criminal history, your current lifestyle, your employment. All that stuff factors into the court's decision. Honestly, nobody can tell you with certainty about leniency.
