    Service After the Statute of Limitations is Up
    appreciate that. One last question. If they have tried previously to serve me unsuccessfully and after the SOL is up they try again I'm assuming that the most current attempt in court will be what they base it off of? Also I'm assuming that the SOL starts on my last payment. I've made no attempt to pay it nor has anyone tried to contact me. so I think i'm good with the SOL portion but if they've tried during the time frame. will that screw me?

    How and when did they try to serve you and why was it unsuccessful? How long was that after your last payment? They can always sue you, you would just need to assert SOL as a defense if that happens.

    my parents lost their home early this year the MD judicial website says they tried obviously no one lives there anymore so they tried once and my last payment was in 08 my SOL will be in May of 2012 right now i'm deployed so nothing can be done anyways. But once i'm home if they try again i wanted to make sure that they can't say well we tried before but didn't serve me.

    Uh oh. Houston, we have a problem. The SOL is tolled while you are deployed per the SCRA. That gives them more time to come after you if they choose to.
