Can I Be Emancipated

My question involves emancipation laws for the State of: Texas


I am currently 16 years old and I wish to be emancipated from my mother. My mother has no job and neither does her boyfriend. I am currently working for 20 hours a week at minimum wage. And I have a place to rent out and pay the bill, however my mom does not give consent for me to rent it and it would result me in being a "runaway child". I had enough of my family issues and I want to have freedom from them. I am not allowed to visit my friends, I am not allowed outside the house unless its for my job, My mother keep taking up a phone I am currently paying for. I have all the household chores on-top of my job. My teenage year is suppose to be all about fun however I am restricted inside this house. Why not be emancipated and have that freedom along with the responsibilities I already have.

You do not qualify for emancipation.

Period.

If the emancipation process is about my financial control over my earning over how my parent is treating me is that a reason?
To be able to have properties under my name(i.e. a car) To be able to rent out an apartment without my parent as the main property owner.

You're a very typical 16 year old who has a part time job and is being asked to do chores.

Emancipation is about need - not want.

Are you currently living independently and providing 100% of your financial support, paying market rent for housing, your own utilities, food, clothing, health insurance, transportation, etc.,?

Emancipation is not granted because of the way you are treated. That falls into two categories:

1. Abuse - in which case you will placed in some other adult-supervised placement.
2. Not abuse - then tough, that's the way childhood is

Emancipation is the recognition that the child is already living independently and needs relief from the disability of entering into contracts (like leases, utilities, etc...) that they suffer because they are not yet 18.

Really? Where did you get that idea? Your teenage years are for growing up while getting an education to prepare you for the real world. One part of growing up is chores which help teach you the kind of responsibility needed to be successful in a real job. Your mom's actions? Yes, you should have some fun when you are a teenager. You must learn to balance it with other responsibilities, just like adult life.

Because first, you do not meet the minimum requirements to be emancipated in your state and secondly, because emancipation is not granted on that basis.

But I also have a friend who was just like this kid--in your eyes a 'typical teenager'--and she treated her parents terribly. But even though she wasn't abused, her parents never treated her with disrespect (in fact, they loved her more than anything), she was granted emancipation from her parents. The real kicker is that right now she is living with them because she had to move back to South Dakota. So it's not always about the abuse aspect of it. But I do see where you're coming from with it, and I'm not arguing with that. I'm just arguing the fact that its not just abuse.

I have no idea what point you are trying to make. I never said emancipation had anything to do with abuse. My point is if your parents treat you rotten, you'd be placed (unemancipated) in another setting. With parental consent, emancipation can be done (it's still not a automatic thing). Also note, being allowed to live away from your parents doesn't necessarily entail emancipation.

Texas rules - in addition to being self-supporting a minor must be "17 years of age, or at least 16 years of age and living separate and apart from the minor's parents, managing conservator, or guardian".

The same is true in South Dakota (which has no allowance for 17-year-olds who live at home to petition) - under the statute minors must be living independently. For the record, South Dakota laws have no relevance to Texas emancipation proceedings.

What the abuse comments were about is this: If you're not eligible for emancipation and you need to get out of the home due to abuse, you can report the abuse and state authorities may help. If you're not eligible for emancipation and you really don't like your parents or their rules, but you're not being abused, you are stuck living at home unless you can convince your parents to allow you to move out.
