    Orange County, California Speeding Ticket
    My question involves a speeding ticket from the State of: California

    I got clocked at 66 in a 55 zone. He said he cut me a break and said he'd put me for doing 66 in a 65.

    And the ticket says:

    Speed Approx: 66
    PF/Max.Spd: 55
    Veh. Lmt: 65

    I'm confused on what the vehicle limit means. Did he cut me a break? And also how much do you think my ticket will run for. I haven't had a speeding ticket for almost 3 years so I guess I was overdue for one.

    Vehicle limit refers to the speed limit restriction for certain vehicle pursuant to VC 22406... For all intents and purposes, it doesn't look like the lower limit applies to the type of heicle you were driving... However, as far as I know, the citation is filed by using the alleged speed or "Speed Approx" and the "P.F./Max speed" entries... SO I'm not so sure that he gave you the break he mentioned.

    Only question I would have is this: are you sure it says 22349(a) and not 22349(b)???

    Would there of been any difference if I was doing 67 but he moved it to 66? Because me mentioned something about giving me a break, I just can't really remember exactly what he said. I'm 99% sure he said something about doing 66 in a 65.

    And yea my ticket says VC 22349 (a)

    Nope... The graduated speed versus fine schedule is set up as follows:
    1 to 15mph over the limit - a fine of approximately $230
    16 to 25mph over the limit - a fine of approximately $355
    26 and higher over the limit - a fine of approximately $475

    So 66 or 67 and regardless of whether the limit used as the basis is 55 or 65, it still falls in the "1 to 15 over the limit" bracket, which carries an approximate fine of $230 or so...

    In all honesty, I wouldn't put so much weight on what the officer stated during the stop. I mean even if you bring it up in court, and while they often do especially when it comes to speeding citations, he is under no obligation to give you any sort of break; and bringing it up is not likely to change the outcome much if any at all.

    In my opinion, it really boils down to: how it gets filed with the court, what speed limit and alleged speed you get arraigned on, and how he might describe the violation in court during his testimony or if you bring it up on cross, because those will end up factoring into what type of defense argument you might have, at which time, whether he gave you a break or not becomes immaterial.

    Sorry, but I now realize that in addition to asking you to verify the code section, I should have also asked you to describe the highway you were on. Is it a 2 lane undivided highway -1 lane in each direction with or without a passing lane in the middle-??? (You only mentioned a 55mph limit and I made an assumption that I should have asked you to confirm...)

    It wasn't a highway. It was just on the regular street. And $230 isn't too bad. I got a speeding ticket almost 3 years ago so I'm just going to do traffic school. I don't feel like fighting it, there was no excuse, I was speeding plain and simple. I've been preparing myself for a career in law enforcement too so I just got to man up and own up to the ticket.

    I was just worried about the ticket price overall. What would the difference be if it were 22349(b) instead of a?

    Street/roadway/highway... they all mean the same thing.

    I think it was a street with 4 lanes across on both sides. But the same road does happen to turn into a highway a few miles down.
