Injury During a Shoving Match
My question involves criminal law for the state of: Indiana
My fiance and I got into a heated argument. He was going to leave, he was packing clothes and because he was mad (and I was contributing to this because I was getting in his face and calling him names and antagonizing him) he was trying to take stuff out of our daughters room. She was in bed during this ordeal. She did not witness any of it. But I stood in front of her door in order to keep him from getting into her room so that he could not take what he wanted to take. (which was some of the clothes that he had bought her). He had asked me to move out of the way. I refused, so he tried to move past me. I started pushing back against him and in turn he was also pushing me. There's a hat rack next to our daughters door that has a large wooden base. I tripped on it and lost my footing and because we both had ahold of each other, we ended up falling into the entertainment center right next to her door and I ended up with a small cut on my head. He had tried immediatley to get me to a hospital. And when I refused multiple times to go to the hospital, he had stated that he was going to call the police on himself so that I could get checked by someone. He waited outside for them and he was taken into custody. I have never been in fear of my life with him, This was just a stupid argument that ended in a freak accident. I'm not a fair fighter, I basically fight until I win. I recognize that I need help with this. He has never touched me in an inappropriate manner nor hurt me in anyway. Our daughter did not witness any of it, in fact, when the police got there, she thought it was a big party and was acting like she normally does, all happy and go lucky and just talking to everyone. We both agreed to counseling prior to this incident because we wanted to get married and we wanted to have learn new ways of dealing with arguments. My father and I are going to talk to the prosecutor to see about getting the charges deffered and the no contact order lifted so that we can proceed with counseling and any other classes that we are required to take. We are willing to do anything. Would it be possible for have the charges deferred for the time being until we prove that we have completed counseling and any other classes that have been deemed necessary?

It may be possible for your fiancé to get his charged deferred; that's common for first offense domestic violence cases, but is something he should be discussing with his lawyer. You are free to make your wishes known to the prosecutor.
