Getting Away From Cruel Mother in Arkansas
My mother physically and mentally abuses me. She threatens to kick me out, but won't let me move to my dad's house. She has full custody of me and my father can't afford to take her to court because all his money goes to child support, which she is saving so she can put herself through a cosmetology college.

She doesn't pay for any thing that I need unless it is a dire emergency either. My boyfriend has to give me the money for things I need. My grandparents say that they are going to leave me their house after they pass on, which my mom wants to make me sell to pay off her student loans.

I am only 15 and will turn 16 December 14th. Is there anyway that I can divorce my mom or get an emancipation and move in with my boyfriend who is 18 if he can prove that he can support me? Even if I can't move in with him, is there anything else that I can do?

    Emancipation in Arkansas
You should consider looking into emancipation under Arkansas law. This usually requires demonstrating to a judge that you are employed and financially able to support yourself.

It is my understanding that the minimum age to obtain a marriage license without court or parental permission in your state is 18. However, emancipation also results from marriage, if your boyfriend is willing and you are able to obtain a license under Arkansas law.

Your father may also attempt to gain custody without a lawyer.

I hope your grandparents survive until you are 18. However, if that does not seem likely, they should look into setting up a trust for your benefit, such that the house remains in trust until you reach the age of 18 and your mother can't interfere with your decisions or try to force you to sell the house.

These are issues you (and your father and grandparents) should discuss with a licensed Arkansas lawyer.
