    Voluntary Departure: I-212 or I-601
    I am an US resident and my husband was granted a voluntary departure. I filed the form I130 and the petition was approved. I have consulted with different attorneys and I am being adviced different things. I was told that I have to wait for the visa bulletin to contact me and they will start asking for additional documentation and then file for I212 and I601. The other attorney stated that after exploring my husband's voluntary departure he will only have to file for I601 as due to the voluntary departure he is a 212(a)(9)(b) and does not need to file for I212. I am very confused what is my next step, is there an adjustmentof status I need to file or just wait for the visa bulletin and then file what I212, I601 or both??? Thank you very much for your help

    Your husband is not in the U.S., so he has no status to adjust.

    Thank you!! Do you know if I need to use both waivers or only I601 since he left with a voluntary departure.

    Are you a US citizen or just a LPR?
