AOS for Illegal Immigrant Marrying a U.S. Citizen
Can a person who overstayed their B2 Tourism Visa and lived in the U.S. marry a US Citizen apply for AOS?
I know this question has been asked a billion times so I looked through the forums but I have yet to find one that is similar to this situation.
The said person went through most of schooling in the U.S (5th, 6th grade, middle school, high school, currently in community college transferring to a 4 year University of California) and came to the U.S. legally but overstayed the visa. It's been over 8 years since the said person have lived in California and never left the country. No criminal records.
If this person marries at the end of a 4 year college with an U.S citizen, how long would it take, if even possible, to obtain a green card?
Thank you.
Re: AOS for Illegal Immigrant Marrying a U.S. Citizen
The time is the same as for any other person marrying a U.S. citizen, who is eligible to adjust status based on marriage. Is there some complexity to your question that isn't clear from your post?
