When Will Child Support for My Child End
My question involves a child custody case from the State of: Georgia
I would like to know when my child support order will end....My daughter graduated in May and she will turn 18 in August. Her father asked if he could pay my child instead of paying me when she's in college.
My order clearly states:
Child support shall continue until the child reaches the age of 18 years, dies, marries, or becomes emanicipated, whichever first occurs; provided, however, that should the child be enrolled in and attending a secondary school at the time the child reaches the age of 18, support for the child shall continue until the child is not a full-time student at a secondary school, dies, marries, becomes emancipated, or attains 20 years of age, whichever first occurs.

I'm not seeing where Dad is obligated to pay at all if kiddo goes to college.

It ends when the child turns 18, dies, marries, becomes emancipated.

You seem to be asking 2 questions here:
1) when will my child support end; and
2) can my husband pay my child her child support instead of to me.
As for question #1 - the order is very clear. When you say she has graduated, I am presuming you mean graduated high school, which is synonymous with graduating secondary school. Since she has graduated secondary school, the child support ends when she is 18 unless she marries, is emancipated or dies before then.
As for question #2 - that is up to you. Until your child reaches 18, she is a minor in the state of Georgia and the child support goes to you as the custodial parent (which is what I am assuming you are since you are receiving the child support). Once she reaches the age of 18, the child support ends. If she dies, marries or is emancipated before she reaches the age of 18, the child support ends.

Are you and your husband under the mistaken impression that secondary school means college? It does not. Secondary school means schooling above elementary school but prior to college - in other words, junior high (middle school) and high school. Grades 6-12.

Thank you, I was referring to this more so "support for the child shall continue until the child is not a full-time student at a secondary school, dies, marries, becomes emancipated, or attains 20 years of age, whichever first occurs."
The child just recently graduated from high school and will not turn 18 until August.

Support ends in August, who is enforcing this order? Is CSE involved?
